Spot98.net Terms of Sale

  1. All orders need to be Pre-Paid in full before we process them for picking, cutting or printing. All Prices are in USA Dollars currency, they are Processed and converted to your currency via PayPal Online or by your bank with paper checks.

  2. All Sales are final since we only proccess orders after the buyer confirms the details of the order by providing Payment.

  3. YOU MUST BE OVER 16 YEARS OLD TO BUY FROM SPOT98.NET
    Please have an adult contact us if you want to buy our Products and Services.

  4. Applicable Taxes are Additional to the Purchase Sale Amount on the Order.
    These Tax amounts vary depending on where the goods are shipped. For Canadian delivery destinations the base retail tax amount is 13%. For Canadian Provinces where the base tax amount is different or for Canadian residents with other tax exemptions, we refund any tax balance amount within 72hrs. after your payment in full is received.

Ordering from Spot98.net Policy

  1. Clients can Order and Pay Online via our Shopping Cart and the Paypal Payment Processing System (Google Pay soon available). This is the quickest Ordering Method due to our Online Ordering System.

  2. ONLY Existing Clients in good standing can place orders with Spot98.net by phone, sms, email or fax.

  3. New Clients can NOT Order by phone, sms, email or fax.

  4. All Orders for Spot98 Products and Services need to be placed directly from Spot98.net website. However, depending on the product type and availability, Spot98.net may ship the goods from the nearest *Outlet Store* in an effort to reduce shipping costs and faster delivery to benefit our customers.

  5. It is the customer's resposibility to Order Products and Services from Spot98.net that DO NOT Infringe on ANY Copyright or Trademarks.

  6. Customers need to follow Spot98.net ordering proceedures. By doing so, it helps us get orders processed and shipped quickly.

Order Processing

  1. All Paid Orders are Processed by 10:00 AM EST of the next business day following your Order Payment Date/Time.

Order Changes - Changing Shipping Address or Items

If you contact us relating to order changes AFTER 10:00 AM EST of the next business day after your Order Payment Date, unfortunately NO changes to your order are possible. This is Because by 10:00 AM EST following your Order Payment Date your order has already been Processed, Picked, Made, Packaged and Assigned/Shipped.

Adding Items to your Order

  1. Adding items to a paid processed Order is Not Possible. This is because we process every order seperatly with the according invoice/bill.

  2. The ONLY way to add items is by placing a NEW ORDER or CANCEL the first Order and RE-ORDER ALL the Items. However, this is ONLY POSSIBLE when the customer informs us of this change before 10 AM of the following day.

Order Cancellations Policy

  1. For Order Cancellations, you must contact us no later than 10am EST of the following business day after your Order/Purchase Payment recorded Time.

  2. If you miss the next day 10am EST cut-off time and the order is shipped, you are allowed to return STOCK ITEMS for a full refund LESS our shipping cost and a 20% RE-STOCKING fee of the Total Value of such Stock Items. NON stock items a NOT returnable.

Item Returns Policy

ALL ITEM RETURNS REQUIRE A RETURN AUTHORIZATION NUMBER

You need a Return Authorization Number/Code issued by our head office before you can return any of the accepted Items according to our Item Return Policy. Items returned without a Return Authorization will NOT be accepted and return back to sender.

Only Year Round STOCK Items ARE Returnable

What are the Year round Stock Items?

Stock Items are items we Catalog, Stock and Sell year round.

Examples:
  1. Transfer Sheets, Letters, Numbers and Stock Decals made with plastisol ink that come on transfer sheets.
  2. Teflon Sheets.
  3. Material Lengths and Yardage.
  4. Transfer Paper media like Jet Transfer sheets.

What are NOT Year round Stock Items?

NON-Stock Items are CUSTOM MADE ITEMS Only for YOU.

Examples:
  1. Custom Cut/Made Letters, Numbers and Decals from vinyl, flock, glitter-holo, pattern materials.

  2. Any Other Custom Made Heat Transfers. Plastisol inks, flock etc.
  3. Custom Printed Garments, like t-shirts hoodys etc.

Stock Item Return Policy

  1. Stock Items can be returned, damage free, with prepaid freight, with a 20% re-stocking fee, within 30 days. A refund will be issued within 60 days after the goods have arrived at our warehouse.

    Returnable Stock Letters, Numbers, Decals Sheets must meet the following criteria:

    Goods must be returned in the same form as you received them. Not Used, in the original package/envelope you received them.

Item Exchanges

  1. Customers are allowed to exchange STOCK ITEMS ONLY and must complete a Return Authorization Form.

  2. Once the Items are recived at Spot98.net, the exchange replacement items are shipped at the customer's expense. We contact the customer via email with the exact shipping amount and we provide a link where the customer can make the shipping charges payment.

Returning Materials Sold in Lenghts/Yards

These Materials include Vinyl, Flock, Foils, Glitter-Holo, Jet Transfers and Teflon Sheets Material full Roll Goods/Yardage and Teflon Sheets can be returned, damage free, prepaid freight, with a 20% restocking fee within 30 days.

Cut down Material Sheets are NOT Returnable

Cut-down materials to 9"x15", 9"x19" and 9"x20" or any other lengths are not allowed to be returned because we do not stock them as such. They are cut to size when you place your order.

Custom Made Items are NOT Returnable

Custom made items can NOT be returned because they are custom made according to the customer's order specifications and can not be re-sold.


Returns Due to Freight Damages

  1. With Damage goods due to freight, SPOT98.NET must be notified immediately.

  2. The damaged goods must be returned in the original packaging no later than 30 days of the invoice.

  3. The claim will be evaluated and refunded. Provide pictures of damage, if possible. This will help us dealing with the carrier responsible for the damage.

Payments / Transactions and Currency

  1. Clients can Pay Online with Credit Cards and Bank Debit Cards via www.paypal.com or with Paper Checks. Our payment currency is in US Dollars.

  2. To help protect client information, Spot98.net ONLY deals with the Person that has Paid for the Order relating to Payments or ANY other Trasaction Information.

  3. Credit Card Payments

    1. DO NOT contact us with any of your Credit Card Information to Pay. All Credit Card Payments are Processed online ONLY.

    2. SPOT98.NET DOES NOT TAKE CREDIT CARD INFORMATION
      BY PHONE, SMS, FAX OR EMAIL.


    3. All Paypal, Visa, Mastercad, Amex, Direct Payment and Echeck Online Payments are Processed by Paypal (www.paypal.com). Paypal is the world's leader in Payment Processing with high Security and Privacy Stardards.

    4. Paying with Paypal or Credit Cards are the fastest Order Processing Payment Methods. All Orders paid via this method are Processed at 10 AM ESTof the following business day after we receive your Payment Email Notification from Paypal.

    5. You Do Not Need to Set Up a Paypal Account
      to Pay with Credit Cards.


    6. At Checkout, customers are Directed to the Secure Paypal Payment page. There customers have the choice to pay with your Credit Card without setting up a Paypal Account. Alternatively, customers can set up a Paypal Account or Pay with Paypal.


  4. Paying with Paper Checks

    1. Pay with Paper Checks and Save 5% Off your Total Purchase.

    2. Clients can Pay with Company, Personal or International Money Order Paper Checks.
      With these payment methods, we offer 5% off your total purchase. You simply print out the Checkout Page of your Order, deduct 5% off your purchase and mail it along with your Paper Check Payment to our Head Office. Your Order gets Processed after your Paper Check clears the Bank. Usually a couple of days.

Payment Currency

  1. SPOT98.NET prices are all in US Dollar Currency.

    We accept Payments in US dollar currency as our primary currency. These payments are converted to the clients's currency (if you are not a USA resident) by the client's bank or financial institution.

  2. When the customer is not able to pay for purchases in US Dollar currency, please contact us. We will do our best to assist but we do not guarantee a payment currency change will be done.

    The reason we use the USD Currency is because we sell worldwide and because currency values change on a daily basis, making it extremely difficult to have set amounts for all global currencies.

Problems Paying Online

We understand that sometimes Our Shopping Cart or the Paypal Processing Center may be having technical difficulties, or some other issue that creates a problem ordering and paying online. Here are a few things you can try:

  1. Always buy and pay directly from the Spot98.net website. To do so, be sure to type in your internet browser address bar http:/www.spot98.net/.

  2. With Large Orders that contain a lot of different items try ordering and paying for half of the order and the other half seperatly.

  3. Make sure your Internet Browser Javascipt is ENABLE and that your computer's security system allows you to properly view the Spot98.net site. Spot98.net is a SAFE website.

  4. Alternatively, the customer can mail us a Paper Check Payment (you also save 5%) along with the order and shipping information.

Payment Notifications

  1. After the Customer has paid for the Order, Spot98.net sends the Customer an Automatic Payment Received Notification Email to the Customer's registered Email Address provided to Spot98.net by Paypal.com.

  2. PLEASE DO NOT Reply to Spot98.net Automatic Payment Received Notification Emails, they are Automaticaly generated. *YOU WILL NOT GET A RESPONSE*.

  3. To Contact Spot98.net about your Order or Payment, the Customer must use Spot98.net Confidential Contact Forms within the *HELP CENTER* Menu of the website. This is to help Safety and Protect Customers Privacy.

Paypal Payment Processing and Policy

  1. Spot98.net DOES NOT Collect ANY Customer Confidential Payment Information. Like Credit Card Numbers. Paypal.com is WHO collects such information when Customers Pay for goods purchased on the Spot98.net website.

  2. Spot98.net ONLY ships out Orders after Paypal.com provides Spot98.net with a Payment Notification Email.

  3. Spot98.net is NOT responsible for ANY Customer Payment errors. Like double payment for the same Purchase. However, we will refund such error payment amounts as we notice them.

  4. Paypal.com charges the customer's Credit Cards, NOT Spot98.net. When there is an issue with Credit Card Statements, the customer must contact Paypal.com.

Refunds, Item Exchanges and Credit Notes

NO EXCHANGES OR REFUNDS
on First Quality Custom made goods specificaly made for customers.


Refunds

  1. With allowed Full or Partial Refunds, these refunds may take up to 72hrs to be completed or longer depending on the receiving Bank, Credit Card Company or any other Financial Institution.

  2. Refunds are issued in the same currency and payment method the original payment was received.

Credit Notes

  1. Credit Notes must be used up within 1 years. They can NOT be converted to Cash Payments.

  2. Only the person that has received a Credit Note can used it.

  3. For SEND US YOUR PICTURES Credit Note, the dollar amount is dedected OFF your next purchase.

Shipping & Delivery Policy

We Ship Worldwide to all Friendly Nations
All Stock Items Ship next Business day. Custom made Orders may take a few days.

WE CAN NOT ACCEPT ANY LIABILITY FOR THE FAILURE
OF ANY CARRIER TO FULFILL A PROMISED DELIVERY TIME.

  1. All orders are shipped F.O.B. Spot98.net Warehouse Toronto Canada or Spot98.net Global OutLet Store locations.
  2. All Orders valued at $ 75.00 or more shipping to Canada and USA include a tracking number and insurance.
  3. The customer must use the Order Tracking System to check on Order/Parcel Shipping / Status.
  4. Some Order shipping may be broken down into various parcel shipments when the goods are located and shipped from different Spot98.net OutLets thru out the globe. At no charge to the client.
  5. The client chooses the Order Shipping and Service before checkout. It is NOT possible to Pay and Order from Spot98.net without choosing the Order Shipping Method and Service first.
  6. Clients must allow reasonable transit time for delivery according to the shipping and order service chosen by the client at checkout.
  7. Sometimes there are delays beyond our control.

Correct Shipping Address

  1. It is the client's responsibility to provide us with the Correct Shipping Address and to ensure their Financial Institution (Credit Card Company, Paypal or any other Financial Institution) used to pay for Purchases has the clients's Correct Shipping Address up to date.

  2. We ONLY ship goods to the Address provided by the client and it must be the same as the registered Address of the person who paid for the goods.

Change Shipping Address

  1. In the event the customer recently moved, changed Address or it is a Special Order (a gift for example) and requires the goods to be Shipped to a different Address other than the client's, the client must inform us before 10AM of the following business day after the order/payment date.

  2. With any Address Change Customer Request, we may ask for more information and/or refuse to ship the goods. In some cases, Paypal and Credit Card companys may hold the payment funds until the addresss change is confirmed.

Orders Shipped to Wrong Address

  1. When we make a shipping address mistake, we re-ship the goods free of charge.

  2. When Orders are Shipped to the WRONG Address because the Shipping Address provided by the customer or their Financial Institution is NOT Correct, the customer is responsible for any additional costs of RE-SHIPPING the goods after these goods are returned back to ud UNDELIVERABLE.

  3. To RE-SHIP the goods to the Correct Address,
    the client MUST complete and submit the: My Order Was Shipped to The Wrong Address Form.

  4. In the event the customer does NOT want the goods RE-SHIPPED, there are NO REFUNDS on Custom Made Goods. With Year Round STOCK ITEMS a REFUND is issued within 30 days after the sale date LESS a 20% re-stocking fee of the total sale amount plus any other expenses we inccur may be deducted from the total refund amount.

Order Tracking/Status Inquiries (please read)

In order to help ensure your safety and protect your PRIVACY relating to your order payment and other personal information, we require that ALL Order Status Inquiries are processed via our Online-Order-Status Form. This will also help us serve you better tracking your Order/Parcel.

To complete the Order-Status Form, please reference the ORDER CONFIRMATION Email sent to you by PAYPAL that includes the information we need to proceed Tracking your Order/Parcel.

To Track Your Order/Parcel, the following information is required.

  1. Payment Transaction Number Issued by Paypal.
  2. The complete Name of the person who paid for the Order.
  3. The Ship to Address.
  4. Time and Date of the Order.
  5. The Shipping method chosen at Checkout.

Shipping & Handling Charges

  1. Order Service and Shipping & Handling Charges are Additional to the Purchase Sale Amount on the Order.

  2. Order Service/Shipping charges are automatically calculated based on Purchase Value, Zone Destinations, Type of goods purchased and delivery time. With some odd shape goods and delivery destinations additional charges may apply, we inform you in advance during the Order Processing period.

Shipping Methods

  1. You Choose the Order Service and Shipping Method at Checkout.

  2. We Offer 3 Shipping Service Methods. STANDARD, EXPRESS and RED-EYE (Fedex, UPS Shipping). We also offer EXPRESS and RED-EYE (Fedex, UPS Shipping) Order Service.

  3. You choose the Order Service and Shipping at Checkout. In the event you decide to change your Order Service/Shipping Method after you have already paid for your order, you can do so within 12 hrs. after your purchase payment.

  4. The Customer may also choose their own shipping method or Carrier Company by informing immediately after the order and purchase payment. We then adjust any cost amount accordingly.

STANDARD

Ships out in 24 Hrs. Tracking Number Included on Orders over $ 75.00. Ships VIA STANDARD AIR MAIL. WorldWide. Transit Time 3 days to 3 weeks depending on destination.

EXPRESS

Ships out in 24 Hrs Tracking Number Included. Ships VIA EXPRESS AIR MAIL - USA/Canada. Transit Time 3-8 Business Days depending on destination.

RED-EYE

Ships out in 24 Hrs. Tracking Number Included. Ships VIA FEDEX/UPS at 8 PM EST USA/Canada. Transit Time 1-2 Business Days. May NOT be possible with some custom made orders or Odd shape goods.


Orders for Pickup

  1. Online purchases/orders can be picked up by any major carrier (Fedex, UPS etc.) on the customers carrier account when the goods are ready to ship. The customer needs to inform us of their account number with the carrier company and we take care of the shipping.

  2. Orders for pickup by major carriers must be PAID IN FULL before they can be released for Pickup.

  3. Online purchases/orders via the Spot98.net website can NOT be picked up by the customer in person or at any of Spot98.net retail outlets. Retail outlets operate independently from Spot98.net online retail store. However, the customer may go into a retail outlet and buy the goods there in person where available.

UPgrade Shipping Service Method

  1. Customers can ONLY upgrade the shipping method to a faster service if the customer has paid for the Order during the last 12 hrs. or before the next business day.

  2. To Upgrade, additional shipping service charges apply.

Artwork / Copyright / Trademark Policy


Artwork Submit

  1. Please DO NOT send us your artwork just to get OUR OPINION about you and your art. This is to prevent future miss-understandings about the original creator of the ART.

  2. Customers can provide us with their Artwork ONLY after we have recived payment for Custom Printing Orders. Our Custom Printing ordering website system is setup to provide the customer with the Art Submit information.

  3. Our Art Department will contact the customer soon after the Artwork has been received if necessary.

  4. SPOT98-net DOES NOT fix or touch up your artwork to make it ready for production. This is to ensure that NO changes are made to the customer's Original Art files submited. All Artwork must be received production ready. If not, art charges and production proof charges may apply.

  5. The customer may HIRE a Spot98 artist/graphic designer to alter, fix, create or re-create customer artwork. ART CHARGES APPLY and the customer is Invoiced for this service.

  6. For Custom Screen Printing Process as with Custom Plastisol Transfers or Direct to Garment Custom Screen Printing, Film Output and Screen Art Charges always apply. For Decorative Materials and Digital Full Color Heat Transfers, there are NO Film Output or Screen Charges because these are NOT Screen Printing Process type transfers.

  7. Spot98.net provides the customer with 1 FREE of charge Production Proof for each Custom Printing Order/Design over $ 100.00 USD value. Additional Production Proofs for the same Order/Design are $ 25.00 USD each Proof.

  8. All volume custom printing orders require the customer to approve the Production Proof before the production work begins.

Copyright / Trademark Artwork Policy

  1. All our custom artwork, films, negatives, positives, screens, disks, etc. used in the course of production shall remain the exclusive property of SPOT98.NET, unless agreed otherwise at the time of sale.

  2. SPOT98.NET may refuse to do any work in the event the Artwork provided by the customer appears not to be their own and without authorization from the original creator of the Artwork.

  3. SPOT98.NET is not responsible for any customer false and miss-leading representations relating to any work we are hired to do. Customers must inform us of any copyright/trademak content before we are hired to do the work and Provide Spot98-net with CLEARANCE in writting.

  4. All the work we are hired to do to produce goods ARE the responsibility of the customer in the event that the Artwork is not legal or authorized for re-production.

Artwork General Requirements for Production

  1. Must NOT infringe on copyrights or trademarks.
  2. Artwork must be finished and ready.
  3. Resolution at 300 dpi.
  4. Artwork with Font Text, the Text must be converted to curves.
  5. File formats, VECTOR files only, CDR, PDF, EPS, AI.
  6. NO Photoshop files or any other file types that are NOT VECTOR Files.
  7. For One color art, provide Artwork in Black color without Backgrounds.

Product Guarantee Statement

  1. All products sold by Spot98.net are quality tested on a regular basis. No products are shipped out and sold without being tested by our Quality Control.

  2. In the event you do receive a defective item, please inform us of such immediately.

    We Guarantee to replace any item that is defective in materials and workmanship free of charge.
    NO REFUNDS, EXCHANGE ONLY or Store CREDIT NOTE within 30 days of delivery.


  3. There are no other warranties, express or implied, including but not limited to express or implied warranty of merchantability or fitness for a particular purpose.

  4. We cannot be held responsible for products which have been laundered with soaps containing bleach, or harsh detergents with bleach or bleach particles. SPOT98.NET carefully prints washing and application instructions on all product information sheets delivered with orders.

    All Products come with FREE Extra Testers. Use them to practice.

Wholesale / Resellers Terms of Sale

Payments

  1. First time Orders are processed/shipped with Credit Card, Paypal or pre-paid Paper Check payments until credit has been established. To apply for Credit Terms you will need to complete and submit a Credit Application.

  2. Existing clients may continue to Order and Pay as per the current Payment agreement.

Placing Orders, Order Charges and Back Orders

  1. For existing clients Orders can be place Online, Phone or by Fax.

  2. New Clients may ONLY ORDER Online via our shopping cart.
    NO PHONE OR FAX ORDERS.

  3. For Bulk Custom Plastisol Heat Transfers, please read the additional Terms and Conditions and Ordering Information.

  4. Add-on to Orders, Order Changes and Order Cancellations are NOT possible after 10 AM EST of the following business day from your purchase payment date/time. This is because of our Speed with Order Processing.

  5. When a Stock Item is SOLD OUT at the time when we process your order, the Item is placed on BACK ORDER and is shipped with NO SHIPPING CHARGES when it is back in-stock. Items are usually back in stock in a few days.

    If you do not want Back orders, you need to inform us.

  6. In the event you Order and Pay for a Deleted/Discontinued item(s), we will offer a replacement or refund the dollar value of such item(s).

Wholesale Re-Seller Requirements:

  1. International Worldwide Re-Sellers Must have a valid re-seller permit/license (or will be getting one soon) according to your local goverment business and taxes policy/laws.

  2. Canadian Re-sellers must have a valid GST Business number, PST permit in Ontario or any other tax exemption permit where applicable. You need to provide us with these business and tax numbers for wholesale price level.

  3. You must set up a Wholesale Account to Qualify for Wholesale Level Prices.

  4. After the Client submits the Wholesale Account Setup form, the account is automatically setup. The client can proceed and buy goods as priced in the re-seller/wholesale zone of the site. No account setup confirmation is sent.

Outlet Stores Policy
